RIGHTS OF PATIENTS AS CONSUMER OF MEDICINES:Let’s discuss the comprehensive overview of patients’ rights in India when using medicines from pharmaceutical companies, and practical ways to safeguard those rights.

Patient rights in India especially around Medications is very pivotal in taking care of patient’s health and save him from corruption .
Based on the Charter of Patients’ Rights and legal frameworks in India, here are key rights that directly pertain to the use of medicines:
1)Right to Information:He is entitled to clear, appropriate details about his illness, prescribed medicines (including generic alternatives), expected outcomes, risks, and costs in a language you understand.

2)Right to Access Medical Records:
He can obtain copies of his prescriptions, investigation reports, and case documents typically within 24 hours of admission or 72 hours after discharge.

3)Right to Choose Pharmacy or Lab:
He decides where to purchase medicines or get tests done. Hospitals can’t force him to use their in-house pharmacy or diagnostics.

4)Right to Transparency in Costs:
Hospitals must display treatment, test, and medicine rates prominently, and bills must reflect itemized, transparent information aligned with NPPA pricing where applicable.

5)Right to Informed Consent:Before starting any treatment especially one involving pharmaceuticals he must be informed about benefits, risks, alternatives, and implications. Consent should be given knowingly, freely, and, when required, in writing.

6)Right to a Second Opinion & Alternative Treatment:He may consult another doctor and explore alternate treatment choices even if different from his doctor’s advice. Both the primary physician and hospital must provide him records without undue delay.

7)Right to Confidentiality & Privacy:
His health records and prescription details must remain private. Sensitive procedures (e.g.examinations) must maintain dignity and privacy; a female attendant must be allowed if applicable.

8)Right to Seek Redress for Grievances & Negligence:
He can file complaints through various channels like –
a)Consumer Courts (for deficiencies in service or overcharging).
b)Medical Councils (for ethical violations).
c)Criminal or Civil proceedings (in cases of serious negligence or harm).
